On assumption, that the foreign employee has already received a Ukrainian work permit and will obtain a Ukrainian work visa for entering Ukraine, such employee as well as his employer will need to complete the following steps:
Registration of the company with Ukrainian immigration authorities
As a precondition to the employees ability to fulfill his duties under the Ukrainian migration legislation, certain actions must be completed by his Ukrainian employer company. In particular, under the Decree of the Cabinet of Ministers of Ukraine "On approval of the rules for the entry of foreigners to Ukraine", all legal entities that employ foreigners must be registered with the relevant local immigration control authority. The registration of the company with this authority (OVIR) is also required to enable the foreign employee to obtain a Temporary Residence Certificate, without which the employee will not be able to leave and return to Ukraine without obtaining a Ukrainian visa each time.
Registration of the foreign employee with Ukrainian immigration authorities
According to the above mentioned decree of the Cabinet of Ministers of Ukraine the passport of the foreign employee must be initially registered by the border guard authorities at the time of entry to Ukraine. The registration is done by the way of stamp printing "ENTRY" ("¯ÇÄ") into the passport. Then the passport of any foreigner who wishes to stay in Ukraine for more than 90 days must be registered with the relevant local immigration authorities.
There is no exact list of documents or procedure prescribed by legislation for registration of a foreign citizen (employee) in Ukraine. Be ready, that in case if you submit your documents for registration of your passport in this authority, it will be exchanged to a paper document with your photo for up to 10 days (passport document substitute) valid in Ukraine only. Due to this aspect you will not be able to leave Ukraine during the period of registration.
Ukrainian Temporary Residence Certificate
Under the applicable Ukrainian legislation, a foreign national who has arrived in Ukraine for the purpose of employment, must obtain a Temporary residence certificate from the relevant local immigration authority.
To obtain a temporary residence certificate a foreign employee should submit duly certified documents which regard to the company he works in (including the tax authorities certificate confirming absence of tax debts and the registration card of the company in the immigration authority), his passport with official translation, work permit, tax ID code, certificate of analysis for HIV and tuberculosis, documents from his landlord on his and his family members’ consent for staying in the flat the foreigner rents (together with the ownership documents for the flat), medical insurance policy, confirmation of payment of state duties, passport size photos of the applicant and a file.
Registration the foreign employee at the place of the employees residence in Ukraine
Under the applicable Ukrainian legislation, a foreign employee must apply for the registration of his/her place of residence within 10 days after obtaining a Temporary Residence Certificate. The following documents must be submitted to local authorities for this purpose:
- a written application;
- the original and a copy of the passport of the foreign employee;
- a notarized copy of the Temporary Residence Permit;
- a receipt indicating payment of the state fees and duties.
